Terms and Conditions

When you engage A ‘la Marketing and Contractors to perform work in an independent contractor capacity, you will be required to accept the below Terms & Conditions.  These terms and conditions are subject to change.

If any provision of the below shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this list and shall not affect the validity and enforceability of any remaining provisions.


COMMUNICATION

My work hours are Tuesday to Friday 9am to 5pm. I am available for general contact and brief discussions outside of these hours with prior arrangement. For any urgent matters outside of these hours I can be contacted, however on occasion I may need to return your call, please leave me a message. The best way to contact me is email and phone, although you are welcome to use Facebook messenger and text message. 

PRIVACY

A ‘la Marketing collect your personal and business information with your consent for the purpose of marketing your business. We will not use your personal or business information, nor share it with a third party for any other purpose. 

The information we collect includes your personal details, email addresses, physical addresses and business details including ABN and ACN. We create and access digital and social media accounts on your behalf and retain the login and password details. We share all the information with you when we create a new account or in the case that we may change a password. 

On occasion we use A ‘la Marketing phone numbers or email addresses to verify accounts when logging in for the purposes of speeding up the process. 

Where Credit Card details are required we do not retain the credit card numbers, expiry dates nor CVV details from the back of the card.

Where necessary, our project team may include outsourced web specialists, content providers, graphic designers, and other professionals. We will advise in advance should another team member be invited in on your project.

All work created in the duration of a project remain purely between yourself and A ‘la Marketing, unless otherwise permission has been granted.

INTELLECTUAL PROPERTY

All ownership of work completed by A ‘la Marketing rests with A ‘la Marketing until full payment has been received. Once we have received your final payment, you will own all visual elements that I have created for you, for the project.

You guarantee that all elements of text, images or other artwork you provide are either owned by you, or that have you permission to use them. 

A ‘la Marketing is not responsible for any legal issues that may arise as a result of your images or content infringing on someone else’s intellectual property rights.

You should supply graphic files and photographs in a high-resolution, appropriate digital format. If you choose to buy stock photographs, We are able to suggest stock libraries and purchase images at an additional cost to you.

QUALITY OF WORK

A ‘la Marketing endeavours to present the highest quality of work. Should you be dissatisfied with any aspect of our work you must contact us within 7 days of the receipt of the work to outline your dispute. A ‘la Marketing reserves the right to discuss your dispute and make reasonable changes, modifications to reach an agreement with you.

Should your dispute be based on your personal dislike of an aesthetic or creative output following our initial agreement and your submission of project scope, a session will be held to determine the exact creative direction of the project.

CLIENT CHANGES TO WEBSITE and DIGITAL MEDIA

A ‘la Marketing cannot be held responsible for any issues or errors that arise as a result of changes/additions made to the social media profile, website or database by someone other than the immediate staff and external contractors directly contracted by A ‘la Marketing..

ADDITIONAL PROMOTIONS

A ‘la Marketing reserves the right to promote our work, be it on our own or external websites and social media platforms, as well through traditional media avenues such as press, radio etc

Additional promotion of our work on your projects shall not breach the above privacy terms. At all times we will endeavour to present a professional, true representation of your business.

QUOTES

A quote will be presented based on the scope your provide. Using the information provided by you, A ‘la Marketing will present the best available price. Quoted rates are an estimate and are subject to change.

A ‘la Marketing reserves the right to adjust project rates should the scope of the project change, or the amount of work required at our end is increased by the request of additional requirements.

Should there be any new, foreseeable charges, we will notify you and obtain your permission before proceeding. Such additional charges will be billed together in the next invoice.  

PAYMENTS and INVOICING

Ongoing monthly work is billed at the start of each month prior to work commencement (prorata for projects beginning part way through a calendar month) Payment must be made within 7 days of invoice receipt.

Projects are billed 50% prior to commencement. Further charges are billed monthly with the final 10% billable upon completion of the project. 

All advertising costs included in invoices at no extra cost to you. Advertising costs must be paid prior to advertising commencing. All printing costs must be paid prior to final print files being sent to printer.

Legal advice will be consulted should a client negate to settle an outstanding account within 60 days of the invoice due date.

A ‘la Marketing reserves the right to increase ongoing monthly work after a 12 month continuous period of work.

CANCELLATION POLICY

Should you decide to terminate a project within the project term and without 30 days notice, the full quoted cost of the project still applies. For projects scheduled for longer than 3 months the 50% deposit, plus all monthly payments up to the time of termination, plus 30 days notice applies.

For ongoing monthly work a 60 day cancellation notice must be provided in writing. The 60 day term will take into account two full month’s payments.

CONSEQUENCES OF WORK

A ‘la Marketing cannot guarantee that our work will always be error-free and therefore cannot be liable to you or any third party for damages, including lost profits, lost savings or other incidental consequential or special damages arising out of the operation of or inability to operate social media accounts, websites or online profiles, even if you have advised us of the possibilities of such damages.
